SUMMARY: MS Bologna, Biblioteca Universitaria, 1736, is a composite manuscript collecting four codicological units. The first one (ff. 1-48) offers Iulianus Pomerius, De vita contemplativa (late 12th century), followed by a selection of texts connected with the Bologna school of law: a series of canons on fast, rare constitutions of Frederick I Barbarossa, papal letters, the treatise De arbitris et iudicibus of the famous jurist Bulgarus. Annotations and texts in verse are added on the last flyleaf. The MS was in the library of the convent of San Domenico in Bologna (founded in 1218) during the Middle Ages, and apparently since the early 13th century.

In 1508 an anonymous scribe wrote in the MS Firenze, Biblioteca Nazionale Centrale, Magl. XV 194 a list of 40 books, partly manuscripts, partly printed (in forma). Some items are described as «di mia mano», in my hand. The list author is Giordano di Michele Giordano, whose name appears in some MSS still preserved in Florence libraries. Giordano was not a professional scribe, but devoted much time of his life to the copying of manuscripts, like many others in Florence during the Quattrocento. His collection consisted mainly of texts in volgare or volgarizzamenti relating to different subjects (science and philosophy, devotional texts, travel, cronache, history, literature and romances), but the choice of texts to be copied or bought was neither obvious nor trivial.

Il Libellus fugitivus, attribuito in numerosi manoscritti e nelle edizioni a stampa al giurista francese Nepos di Monte Albano, è un breve trattato di diritto processuale del sec. XIII, tra i più diffusi in Europa nel basso Medioevo e a stampa nel Cinquecento. In anni recenti sulla sua paternità sono stati sollevati alcuni dubbi. La conferma dell’incerta attribuzione e la prova – finora mancante – che la versione originaria ha subìto rifacimenti e rimaneggiamenti è data dal testo tràdito da alcuni manoscritti – tra cui Montecassino 136, Paris lat. 4603 e La Seu d’Urgell 2030 – che presentano varianti di notevole entità rispetto, ad esempio, al testo del Bologna, Bibl. dell’Archiginnasio, B 2794-2795, ed alla versione trasmessa dalle stampe. Sia la versione originaria che il rifacimento sono stati diffusi per exemplar e pecia.
